Terms of Use

These Terms of Use ("Terms") are an agreement between you and Australian Business Consulting Services Pty Ltd (ABN 58 298 951 711) ("Hospo Pulse", "we", "us"), the operator of the Hospo Pulse alert service available at hospo-pulse.au-abcs.com (or any successor domain) (the "Site") and the associated email digests and alerts (together, the "Service"). By subscribing to the Service, using the Site, or continuing to receive our emails, you agree to these Terms. If you are using the Service for a business, you confirm you are authorised to accept these Terms on that business's behalf.

1. What the Service is

1.1 Hospo Pulse is an alert service for anyone who needs early, reliable visibility of new activity on Australia's public liquor-licensing registers — including compliance and legal teams conducting due diligence, parties inside a register's objection or notice period, industry bodies monitoring market activity, and hospitality suppliers, venue brokers and licensing professionals. We monitor public government liquor-licence registers and send email alerts summarising new licence applications.

1.2 The states and territories we currently cover, and the government registers we draw from, are listed on the Site. We add further states and sources over time; the coverage information on the Site is the current position.

1.3 For applications where the applicant or licensee is a company, an automated AI classifier (currently Anthropic's Claude) adds a venue category, a significance score from 1 to 5, and a one-sentence summary. These enrichments are generated automatically without human review and may contain errors (see clause 4). For applications where the applicant or licensee is an individual, we do not add these enrichments — we show a faithful copy or extract of the fields recorded on the official register only, with a link to the source record.

2. The Service is information, not advice

2.1 The Service is an information and alerting tool only. It is not legal, financial, licensing, planning or other professional advice, and it is not a substitute for the official registers or for advice from a qualified professional.

2.2 Before acting on any alert, you should verify the details against the official government register and obtain your own professional advice. Submission deadlines shown in alerts are drawn from register data and may be wrong or out of date; always confirm deadlines with the relevant regulator.

3. Free and paid tiers

3.1 Free tier. The free tier includes a weekly email digest covering the states we deliver, containing counts of the previous week's licence movements broken down by state, type and suburb. It does not include venue names, addresses or licensee details — those are part of the paid tier.

3.2 Paid tier. The paid subscription is a single plan covering every state we deliver, at $99 per month or $790 per year. All prices are in Australian dollars. We are not currently registered for GST, so no GST is added — the price shown is the total you pay.

3.3 Billing and renewal. Subscriptions are billed in advance through Stripe Checkout for the interval you choose — monthly or yearly — and renew automatically at the end of each interval until you cancel. By subscribing you authorise these recurring charges. We do not currently offer free trials.

3.4 No account or password. Your subscription is tied to the email address you provide. To change your email address, contact us at support@au-abcs.com.

3.5 Price changes. We may change subscription prices, but a change will only take effect after at least 30 days' notice by email, and only from your next billing cycle after that notice. If you don't want to pay the new price, you can cancel before it takes effect.

3.6 GST. We are not currently registered for GST and do not add GST to the price. Australian law requires GST registration once GST turnover reaches $75,000; if we register, we will update this clause and continue to display a single total price.

4. Data sources, accuracy and the AI classifier

4.1 The Service republishes and summarises information from third-party government registers, collected on a periodic (currently nightly) schedule, so the Service will always lag the official registers to some degree.

4.2 You acknowledge that: (a) register data can be incomplete, inaccurate, late, amended or removed by the regulator; (b) the Service may miss applications entirely; (c) where we apply them (company applications only — see clause 1.3), the AI-generated venue category, significance score and summary are automated outputs that can be wrong; and (d) an application appearing in the Service does not mean it is current, valid or will be granted.

4.3 We publish register information as a faithful copy, summary or extract of the public register, with attribution to the source and, where the source licenses its data under an open licence, under that licence. The states and territories we currently cover are shown on the Site (clause 1.2). Our confirmed source licences are: Queensland — data © State of Queensland, republished under the Creative Commons Attribution 3.0 Australia (CC BY 3.0 AU) licence; New South Wales — data © State of New South Wales, republished under the Creative Commons Attribution 4.0 International (CC BY 4.0) licence; Australian Capital Territory — data © ACT Government, republished under the Creative Commons Attribution 4.0 International (CC BY 4.0) licence. As we add further states we display the attribution each source requires. Attribution and source notices must not be removed (see clause 6.4).

4.4 These Terms are between us and you as a user or subscriber of the Service. If you are a person named in register data (rather than a subscriber), these Terms do not govern that; how we handle correction, suppression and removal of register data about individuals is set out in our Corrections, Suppression & Takedown Policy.

5. Cancelling, and our refund position

5.1 Cancel any time. You can cancel a paid subscription at any time by emailing us — no phone call, no cancellation fee. Cancellation takes effect at the end of the billing period you have already paid for. See our Refunds & Cancellations page. The free digest's unsubscribe link only stops the free digest — it does not cancel a paid subscription.

5.2 Refunds. We do not generally refund amounts already paid where you simply change your mind or forget to cancel, except that nothing in this clause limits your rights under the Australian Consumer Law or any other law. If the Service fails to meet a consumer guarantee that applies to you, you are entitled to the remedies the law provides, which can include a refund. 6. Your licence to use the Service; our rights

6.1 We grant you a non-exclusive, non-transferable licence to use the alerts, digests and Site content for your own internal business purposes, including sharing individual alerts or extracts within your organisation and with your clients in the ordinary course of your work.

6.2 Except as allowed by clause 6.1 or by law, you must not republish, resell, syndicate, redistribute or make available the Service, the alert feed, or any substantial part of our content to third parties.

6.3 The compilation, selection, formatting, software, branding and AI-generated enrichments in the Service are owned by or licensed to us. Nothing in these Terms restricts your right to obtain the underlying government register data directly from the relevant government source under whatever terms that source offers it.

6.4 If you share content from the Service as permitted, you must keep intact any attribution to the relevant State or Territory and to Hospo Pulse that appears in it.

7. Acceptable use

You must not: (a) use automated means to extract content from the Site or emails, other than ordinary search-engine indexing; (b) resell or commercially redistribute the alert feed contrary to clause 6; (c) interfere with or disrupt the Service; (d) use the Service for an unlawful purpose; or (e) misrepresent Hospo Pulse content as an official government publication.

8. Service availability and changes

8.1 We aim to keep the Service running reliably, but we do not promise that it will be uninterrupted, error-free or available at any particular time; it depends on third-party systems we do not control.

8.2 If we make a change that materially reduces what your paid tier includes, we will give you at least 30 days' notice by email and you may cancel before it takes effect; we will refund the unused portion of any paid period on request.

8.3 If we discontinue the Service entirely, we will give paid subscribers reasonable notice and refund amounts paid for periods after discontinuation.

9. Your rights under the Australian Consumer Law

9.1 Our Service comes with guarantees that cannot be excluded under the Australian Consumer Law ("ACL"). For services these include due care and skill, fitness for a disclosed purpose, and supply within a reasonable time. Because ACL consumer guarantees currently apply to acquisitions of up to $100,000, they will generally apply to Hospo Pulse subscriptions even when you buy for a business.

9.2 Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy you have under the ACL or any other law that cannot lawfully be excluded.

10. Disclaimers and limitation of liability

10.1 Subject to clause 9, and to the extent permitted by law, the Service is provided "as is", and we make no warranty as to the accuracy, completeness or timeliness of register data, AI-generated enrichments, or any other content.

10.2 Where the law permits us to limit our liability for failure to comply with a consumer guarantee, our liability is limited, at our option, to supplying the services again or paying the cost of having them supplied again — unless it would not be fair or reasonable to rely on this.

10.3 Subject to clauses 9 and 10.2, and to the extent permitted by law, we exclude liability for indirect or consequential loss, loss of profit or business opportunity, or loss arising from reliance on register data or AI enrichments without independent verification, missed or delayed alerts, or unavailability of the Service; and our total aggregate liability is capped at the greater of (i) the amounts you paid us in the 12 months before the event and (ii) $100. Nothing in this clause reduces liability that cannot lawfully be excluded, or for our own fraud.

11. Your responsibility for misuse

If you breach clause 6.2 or clause 7, you are responsible for loss we suffer as a direct result of that breach, except to the extent that we caused or contributed to the loss.

12. Changes to these Terms

For material changes (including price changes under clause 3.5) we will give you at least 30 days' notice by email. Non-material changes may take effect when posted. Changes do not apply retrospectively.

13. Privacy and email

We collect and handle your email address and related subscription information as described in our Privacy Policy. Every marketing or alert email includes a one-click unsubscribe link.

14. Termination by us

We may suspend or end your access for material breach you do not fix within 14 days of notice (or immediately for serious misuse under clause 7), or for any other reason on 30 days' notice, in which case we refund the unused portion of any period you have paid for.

15. General

If part of these Terms is unenforceable, the rest still applies. We may assign these Terms to a buyer of our business on notice to you. These Terms, the Privacy Policy and your Stripe checkout confirmation are the entire agreement about the Service.

16. Governing law

These Terms are governed by the laws of Queensland, Australia. You and we each submit to the non-exclusive jurisdiction of the courts of that state and of the Commonwealth of Australia. Nothing in this clause prevents you from bringing a claim under consumer protection law that applies where you are located.
